Indian government denied trademark of ‘basmati’ rice variety

The Indian Government’s attempt to trademark the “basmati” rice variety in New Zealand has been unsuccessful. This decision follows a similar ruling by IP Australia last year. India’s APEDA filed a certification mark application with IPONZ in 2018. Despite efforts, the Intellectual Property Office of New Zealand did not grant the trademark. The move aims to protect the cultural and economic significance of basmati rice, a staple in Indian cuisine.

The Indian Government has failed in a bid to trademark the “basmati” rice variety in New Zealand.The decision comes more than a year after IP Australia, the agency responsible for administering intellectual property law in the country, made a similar ruling.In 2018, India’s Agricultural and Processed Food Products Export Development Authority (APEDA), a branch of the Indian Government’s Ministry of Commerce and Industry, filed a certification mark application to the Intellectual Property Office of NZ (IPONZ).
