Oregon DEQ proposes to delay CFP compliance deadline due to cyberattack

The Oregon Department of Environmental Quality has proposed delaying the 2024 Clean Fuels Program annual report deadline to May 30, 2025, after a cyberattack crippled its Oregon Fuels Reporting System. The outage, which began April 9, disrupted fuel suppliers’ reporting and credit trading. The DEQ must restore the system from backup, causing data loss and delays in compliance activities.

The Oregon Department of Environmental Quality on April 18 proposed to delay the 2024 annual report deadline for the state’s Clean Fuels Program due to a cyberattack and extended outage of the Oregon Fuels Reporting System. 

According to the DEQ, the agency on April 9 was struck with a cyberattack that crippled its systems, including the Oregon Fuels Reporting System that is used by fuel suppliers to file their reporting for the CFP and Greenhouse Gas Reporting Program, generate and trade CFP credits and demonstrate compliance with the CFP. 

As of April 17, the DEQ had been unable to get the OFRS back up and running. In order to safety bring the system back online, the DEQ determined it must restore to a backup that was taken over the weekend prior to the attack. As a result, many actions taken by participants on April 7 and April 8 have been lost and will need to be redone. 

“April is the busiest month for the Clean Fuels Program’s participants and staff due to the annual report deadline given that many companies must conduct credit transfers and file – sometimes extensive corrections to their quarterly reporting prior to the deadline,” the DEQ said in a document explaining the need to delay the reporting deadline. “Given the duration of the system outage and the need for participants to correct their reports and conduct credit transfers, and in some cases redo those actions if they were lost, the agency has opted to propose delaying the Annual Report and compliance deadline.”

The Environmental Quality Commission is the state body that has the authority to grant such a delay. The DEQ said it will propose the commission approved an order granting the delay on April 25. Under the DEQ’s recommendation, the new 2024 annual report deadline would be set for May 30, 2025.
